Hayden Panettiere’s boyfriend off the hook in domestic violence case, prosecutors say they ‘could not secure a material witness’

Hayden Panettiere’s boyfriend Brian Hickerson is off the hook in his felony domestic violence case involving an alleged fight with the “Nashville” actress last May.

The Los Angeles County District Attorney’s Office abruptly dropped the charge against Hickerson during a court hearing Thursday.

“The case was dismissed. (Prosecutors) said they were unable to proceed,” a courtroom source confirmed to the Daily News.

The source said Hickerson’s right to a speedy trial meant prosecutors were out of time in terms of lining up witnesses.

“The case against Brian Hickerson was dismissed without prejudice today. Our office was unable to proceed because we could not secure a material witness. The protective order also was dismissed,” DA spokesman Greg Risling said in a statement.

Hickerson, 30, was arrested May 2 after an alleged incident at the couple’s home.

According to, the two got into an argument after a night of drinking in Hollywood.

Police arrived at their house around 2 a.m. and noticed “redness and marks” on the “Heroes” star’s body before taking Hickerson into custody, the website reported.

Hickerson was booked and released about nine hours later on $50,000 bail, according to jail records.

Hickerson and Panettiere reportedly started dating in August 2018 after the actress split from her longtime partner Wladimir Klitschko, a Ukranian boxer, with whom she shares 4-year-old daughter Kaya.
